Let’s Make a Deal Official Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility
Let’s Make a Deal (the “Contest”) is open to legal residents of all 50 United States and the District of Columbia who are at least 18 years of age at the time of the entry. Winner must have executed at least 2 successful fix and flip real estate transactions in the past 18 months. Winner must own a valid business entity and have the down payment money and closing costs for the loan in a verifiable account. Winner agrees to execute all legal documents and submit any and all information required to procure the loan and for First Rehab Lending to render a lending decision. Winner agrees to execute a credit authorization and have their credit pulled, as well as sign a personal guarantee to repay the loan. Winner agrees to make timely, monthly payments per the terms and conditions of the Note and Loan Agreement. Employees of First Rehab Lending and other companies associated with the promotion of the Contest and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to Federal, State and local laws and regulations.

2. Sponsor
The Contest is sponsored by First Rehab Lending, located at 538 Broadhollow Road Melville, NY 11747.

3. Agreement of Official Rules
Participation in the Contest constitutes the entrant’s full and unconditional agreement and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent on being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period
The Contest begins on November 1, 2017 at 9AM (ET) and ends on November 13, 2017 at 5PM (ET). Entries that are submitted before or after the Contest period will be disqualified. Submissions will be accepted for the duration of the Contest using the following method:

5. How to Enter
Limit one (1) entry per person, per email address, and per household for the duration of the Contest Period. Entries received from any person, email address or household in excess of the stated limitation will be voided. All entries become the property of the Sponsor and will not be acknowledged or returned.

6. Prize Drawing
On or about November 14, 2017, the Sponsor’s panel of judges will select a potential winner based on merit of application among all eligible entries received. The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner via telephone or email on or about November 14, 2017. If the potential winner cannot be contacted within 3 days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place from the remaining non-winning eligible entrees.

7. Winner Notification
The potential winners will be notified by email, mail or phone. Winner will be required to complete and execute all legal documents and submit any and all information required to procure the loan and for First Rehab Lending to render a lending decision within 7 days of the date of notice in order to claim the prize. . Winner agrees to execute a credit authorization and have their credit pulled, as well as sign a personal guarantee to repay the loan. Winner will only receive the prize/ loan if he/she is approved by our underwriting department. Winner agrees to make timely monthly payments per the terms and conditions of the Note and Loan Agreement. If a potential Winner cannot be contacted or fails to submit all legal documents within the required time period, potential winner forfeits the prize. Potential winners must continue to comply with all the terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner chosen by the panel of judges from among all remaining eligible entrees. Only 3 alternate winners will be selected after which the prize will remain unawarded. Prize will be fulfilled approximately 3-4 weeks after the conclusion of the Contest. Winner agrees to allow First Rehab Lending to post the Winner’s picture along with the public details of the transaction for advertising purposes.

8. Rights Granted by Winner
By entering this content (e.g., photo, video, text, etc.), You understand and agree that First Rehab Lending, anyone acting on behalf of First Rehab Lending, and First Rehab Lending’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. Such information not to include non-public personal information such as social security numbers, account numbers, etc…

9. Prize
Best Rate Fix and Flip Loan: Winner will receive one best rate short term (ONE year renewable) interest-only hard money loan for the purchase and rehabilitation of a non-owner occupied 1-4 family property within the state of New York. Interest rate will be 8.99% with a 1 point fee on the loan amount, total loan amount not to exceed $500,000. Maximum Loan to Value Ratio (LTV) on purchase is 80% and 100% of Rehab funds, not to exceed 70% of the After Repaired Value (ARV). Other closing costs apply; Application fee $300, Underwriting Fee $695, Attorney fee $1,500 & desk review fee $100, other fees may apply such as appraisal fee, property insurance, title etc. Proper insurance on the subject property must be kept in effect for the life of the loan. Loan is repayable with a one year balloon payment at the end of the one year term or renewable within 60 days of balloon maturity. Borrower must request an extension in writing, and pay a 2% extension, fee as well as be current on the loan and have the property properly insured for the extended time frame.

10. General Conditions
In the event that the operation, security or administration of the contest is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problem, or in the event that the Contest is unable to run as planned for any reason, as determined by the Sponsor in its sole discretion, the Sponsor may in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to spirit of the Official Rules or (b) terminate the Contest, and in the event of termination, award the from among the eligible non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, or the Operation of the Contest, or to be acting in violation of these Official Rules or in an unprofessional or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek Damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure of the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision

11. Release and Limitations of Liability
By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective Officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of the participation on the Contest or receipt or use of the Prize (including any travel or activity related thereto), including but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled , scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, or in any Contest related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized during the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to punitive, consequential, direct or indirect damages.

12. Disputes
Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Suffolk County, NY. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of New York, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws any jurisdiction other than New York.

13. Privacy
Protecting your privacy is important to First Rehab Lending. We want you to understand what information we may gather and how we may share it. This Privacy Policy explains First Rehab Lending’s collection, use, retention and security of information about you.

How We Gather Information
As part of providing you with financial products or services, we may obtain information about you from the following sources:

o To consumer reporting agencies;
o In connection with a proposed or actual sale, merger or transfer of all or a portion of a business or an operating unit;
o To protect against fraud.
In addition, we may provide information about you to our service providers to help us process your applications. Our service providers may include billing service providers, mail and telephone service companies, insurers, loan settlement service providers, property inspection companies, attorneys or other professionals. We may also provide information about you to our service providers to help us perform marketing services. The information provided to these service providers may include the categories of information described above under – How We Gather Information, limited to only that which we deem appropriate for these service providers to carry out their functions.
We do not sell customer information. We do not provide customer information to persons or organizations outside of First Rehab Lending, who are doing business on our behalf, for their own marketing purposes.

Once you complete an application online, your personal data is encrypted using 128-bit secure sockets layer encryption technology before it is sent over the Internet. This makes it practically impossible for your information to be stolen or captured when sent through cyberspace. To give more protection to its website users applying for a loan online, First Rehab Lending uses Cookies. Once received, your application is kept encrypted until we are ready to process it. You will get a written copy of your application and will be asked to sign it at or before completion of the loan transaction.

Various areas of our website require data, such as your email address and account number, to let you perform certain tasks (for instance, track the status of your loan online.) In such cases, we gather data from you so that we can interact with you. Otherwise, you may look through the site anonymously and no personal data is gathered. Yet, your visit and the manner you use the web pages, may be recorded for advertising and statistical purposes to help us to improve the website for new guests. We collect and analyze data concerning usage of our website, including domain name, visited pages, time of user session, etc. to assess the efficiency and convenience of our site.

We have many planning tools on our website to help you make the financial decisions that are right for you in the seclusion of your own home. We do not capture the personal information you give on these planning tools. Examples include the Mortgage Principal and Interest Calculator and the Debt Consolidation Calculator.

However, the restriction does not extend to sharing of other information, including your name and address, and your account transactions and experiences, with First Rehab Lending.

Our Security Practices and Information Accuracy
We also take steps to safeguard customer information. We restrict access to the personal and account information of our customers to those employees who need to know that information in the course of their job responsibilities.

Other Information
This Privacy Policy applies to products or services provided by First Rehab Lending. We reserve the right to change this Privacy Policy, and any of the policies described above, at any time. The examples contained within this Privacy Policy are illustrations; they are not intended to be exclusive.

Whistleblower Procedures
Any questionable accounting or auditing matters alleged to be perpetuated by First Rehab Lending, LLC, its management or staff may be confidentially and anonymously reported to our Vice President by sending an email to the following address: info@frlinvestors.com

Additionally, a letter may be sent to us, to the attention of the Vice President First Rehab Lending 538 Broadhollow Road, Suite 401, Melville, NY 11747.

14. Winners List
To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: First Rehab Lending 538 Broadhollow Road, Suite 401 Melville, NY 11747. Requests must be received no later than November 20, 2017.

15. Sponsor
The Sponsor of the Campaign and Contest is First Rehab Lending 538 Broadhollow Road, Suite 401 Melville, NY 11747.

16. Facebook
This Contest hosted by First Rehab Lending is in no way sponsored, endorsed, administered by, or associated with Facebook.
